QuickMocker Terms and Conditions

1. Terms

By accessing the website at https://quickmocker.com, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws.

2. Use License

  1. Permission is granted to temporarily download one copy of the materials (information or software) on QuickMocker's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
    1. modify or copy the materials;
    2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
    3. attempt to decompile or reverse engineer any software contained on QuickMocker's website;
    4. remove any copyright or other proprietary notations from the materials; or
    5. transfer the materials to another person or "mirror" the materials on any other server.
  2. This license shall automatically terminate if you violate any of these restrictions and may be terminated by QuickMocker at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

3. Disclaimer

  1. The materials on QuickMocker's website are provided on an 'as is' basis. QuickMocker makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
  2. Further, QuickMocker does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

4. Limitations

In no event shall QuickMocker or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on QuickMocker's website, even if QuickMocker or a QuickMocker authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

5. Accuracy of materials

The materials appearing on QuickMocker's website could include technical, typographical, or photographic errors. QuickMocker does not warrant that any of the materials on its website are accurate, complete or current. QuickMocker may make changes to the materials contained on its website at any time without notice. However QuickMocker does not make any commitment to update the materials.

6. Links

QuickMocker has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by QuickMocker of the site. Use of any such linked website is at the user's own risk.

7. Modifications

QuickMocker may revise these terms of service for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these terms of service.

QuickMocker may revice free subscription plan without any notice.

QuickMocker will provide an upfront notice with details in case paid subscirption plans are revised.

8. Responsibilities

QuickMocker is doing its best to provide services at a highest availability rate. Though, we cannot guarantee 100% uptime. In case of downtime, please contact us.

QuickMocker is not responsible for data-loss, recovery, or compromise of data, software or programs, or loss of use of your product/service or other equipment arising out of the services provided by QuickMocker. QuickMocker is gathering minimum of your personal information required to allow your account to function properly, which minimizes any risks related to the data breach. Nevertheless, you acknowledge that you provide your personal information at your own risk.

When creating an account, you must provide accurate information. Only you are responsible for the activity that occurs on your account. Please make sure you keep your account password and other credentials secure.

You understand that only you are responsible for the content you create, undertake neither by yourself nor by permitting any third party to host, upload, modify, publish, transmit, update or share any information that:
- belongs to another person;
- is harmful, harassing, blasphemous, defamatory, obscene, pornographic, pedophilic, seditious, libelous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever;
- harms minors in any way;
- infringes any patent, trademark, copyright or other proprietary rights of any person anywhere in the world;
- violates any law for the time being in force;
- deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;
- impersonates another person;
- contains software viruses, Javascript/HTML injection, or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource;
- is insulting to any nation;
- is illegal in any other way.

In case we find out that you violate the rules above regarding the content you create, we reserve an unilateral right to remove this content along with your account.

9. Subscription plans (free and paid)

QuickMocker provides services based on the subscription plans. Each subscription consists of a specific set of features and its monthly quotas (see more at pricing section). Currently there are 3 subscription plans:

  • Free - this plan is available for every user right after the registration or after a premium subscription plan is not renewed.
  • Advanced - paid subscription plan with more features and less limits.
  • Expert - paid subscription plan with all the features and least limits.

You understand and agree that QuickMocker has the right to change the subscription plan features and its quotas limitations at any given time.

10. Subscription payments and its frequency

In case you purchase a paid subscription, you understand and agree that the payments are done regularly and automatically in order to renew the subscription plan. During the payment process you can select the recurring payments frequency. Currently there are only 2 available payment frequencies: monthly and annually. The first payment is made at the time when you complete a subscription purchase. The subsequent payments are done regularly every next month or year (depending on which frequency you have chosen) on the same day of the month when the first payment was done. In case the first payment was done on the last day of the month, then all subsequent payments will be done on the last day of each following months (e.g. January 31, February 28, March 31, April 30 and so forth) or year (e.g. February 29, 2020; February 28, 2021 and so forth). In case payment was done between 29th and 30th day of the month, but not on the last day of the month (e.g. 30th of April), then on the months that have less amount of days, the payment will be done on the last day of the month (e.g. February 28).

You have the right to disable automatic renewal at any given time. Your subscription will be still active with all its features and quotas available for you until the upcoming renewal date.

We also allow you to request a partial or full refund for the current subscription period (month or year). Just write us a short message through our contact form using the corresponding subject "Refund request" and tell us what was wrong with our service or why you'd like to get your refund. We will get back to you within 5 working days with the resolution regarding your refund request. After this, it might take from a few days and up to a few weeks while the money will be transferred back to your bank account depending on the banks involved in this process. Please note that payments under 0.5USD (discounted payments) cannot be refunded.

11. Payment processing

QuickMocker does not process any payments on its own. Instead we rely on a 3rd party service payment gateway Fondy. Therefore we do not process or store your payment method details (e.g. credit/debit card information). During the payment procedure, the 3rd party generates a payment form for you by our service request. After you provide your payment method details and complete the payment procedure, QuickMocker application receives from the 3rd party the result of the transaction with customer token (unique number that is linked with the customer), which means QuickMocker never gets information about your payment method details (e.g. your credit card or debit number).

From our side we strictly follow all the security rules that are defined by 3rd party payment gateway Fondy in accordance to the requirements in Fondy Terms and Conditions document in order to make your payment method details and payments secure.

Please note that your bank might show the cost of your purchase in UAH (Ukraine Hryvnia) currency due to our location and payment processor. Nevertheless, this currency conversion does not affect the final cost in USD which will be equal to the price of the coresponding subscription plan.

12. About these conditions

We may change these terms or any additional terms that apply to the Service, for example, to reflect changes in legislation or changes in our Services. You should review the terms on a regular basis. We will post a notice of changes to these terms on this page. Changes will not be retroactive and will take effect no earlier than seven days after they are posted. However, changes relating to new features of the Service or changes made for legal reasons will be effective immediately. If you don't agree with the changed terms and conditions for the Service, you should stop using the Service. These terms control the relationship between QuickMocker and you. They do not create any third-party rights for the beneficiaries. If you do not comply with these terms, and we do not take immediate action, it does not mean that we waive any rights that we may have (such as future actions). If any of these Terms are found invalid, the remaining Terms will remain in effect.
